Appeals
There are usually two types of appeals. The Board of Immigration Appeals (“BIA”) in Falls Church, Virginia is the first type of appeal for the majority of cases from the Immigration Court and from U.S. Citizenship and Immigration Services (“CIS”). There is a thirty (30) day deadline for most appeals to be filed with the BIA, and most require a $110 filing fee.
Process
After the BIA, your case may be appealed to the United States Circuit Court of Appeals for the Ninth Circuit, located in San Francisco, California. Like the BIA, petitions for review must be filed within thirty (30) days of the decision being appealed. Unlike the BIA, attorneys must be specially admitted to practice before the Ninth Circuit. There is a filing fee of $500, but it can be waived in many cases.
